Where possible, for orders up to 20kg in actual or cubic weight (whichever is the highest), we use Australia Post for delivery.  Signature is required on receipt/collection of goods – goods will not be left unattended at any premises.

Shipping costs vary depending on the size and weight of the product or your total order and will be displayed to you when checking out.

 

Privacy Statement

We are committed to protecting your privacy.  We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act).

We collect information about you for two reasons: firstly, to process your order and secondly, to provide you with the best possible service.

We will give you the chance to refuse any marketing email from us in the future.

The type of information we will collect about you includes:

Your name
Address
Phone number
Email address
Location details
Credit card details (these numbers are processed directly and are not stored in any database online).

We will never collect sensitive information about you without your explicit consent.

The information we hold will be accurate and up to date.  You can check the information that we hold about you by emailing us.  If you find any inaccuracies we will delete or correct them promptly.

The personal information which we hold will be held securely in accordance with our internal security policy and the law.

We may use technology to track the patterns of behaviour of visitors to our site.  This can include using a "cookie" which would be stored on your browser.  You can usually modify your browser to prevent this happening.  The information collected in this way can be used to identify you unless you modify your browser settings.

SECURITY

Our payment options available are endless, but most of importantly safe and secure. We offer Credit Card processing, Direct Deposit, Cheque and Money Orders.

Credit Card payments are made directly through DirectOne's 128 bit SSL Encryption software to insure your personal details are kept safe. None of your payment details are stored, this ensures you will be happy with your transaction.

Terms and Conditions

INTRODUCTION AND GOVERNING LAW

These are the Terms & Conditions of Sale applicable to on-line purchases from The Bowls Shoppe.

These terms and the laws of Victoria, Australia, apply to all transactions for the purchase of products ("Products") from The Bowls Shoppe through its website at www.thebowlsshoppe.com.au and any associated web page ("the Site").  These terms represent the complete agreement between The Bowls Shoppe and the Buyer covering the purchase of Products from this site.  Except for terms implied by applicable legislation, The Bowls Shoppe does not offer or agree to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms.  The Buyer's completion of the order form on this site will constitute an offer to the Buyer to purchase Products (the "Order").  All Orders are subject to acceptance by The Bowls Shoppe.

PRICES

The prices to be paid by the Buyer for all Products will be The Bowls Shoppe's current selling price on the date of receipt by The Bowls Shoppe of the Order, less any applicable discounts in effect at that time.  All Orders will attract a delivery charge as set out on the Checkout.

The Bowls Shoppe will not be responsible for errors in pricing that appear on the Site.  The Bowls Shoppe will notify a Buyer in the event of a pricing error on the Site before an Order is delivered.  The Buyer will have the opportunity to cancel their Order within a reasonable time.

The Bowls Shoppe reserves the right to change its prices from time to time without prior notice to the Buyer.  All prices in this website include Australian Goods and Services Tax (GST) at 10%.

The GST payable by the Buyer will be shown on the invoice which The Bowls Shoppe will send to the Buyer.  Delivery charges to the nominated address will be advised to the Buyer on the Checkout and Order confirmation pages of the Site.

STOCK AVAILABILITY

If a standard order Product is "Unavailable to Ship" within 3 business days after The Bowls Shoppe processes an Order, The Bowls Shoppe will contact the Buyer to discuss delivery times or refund options.  On custom and special order products, The Bowls Shoppe will contact the Buyer should the expected delivery time exceed the time allotted for shipment of that product.

ORDER DELIVERY AND CANCELLATION

All Orders by the Buyer under this Agreement must be placed via the forms provided on this Site and must specify the information requested, including (but without limitation):

(a) Quantity and description of Products;
(b) The full street address to which the Product is to be delivered;
(c) Current billing address to which credit card statements are sent should a credit card be used for payment.

The Buyer must complete all information requested on the Order form before the Order is processed by The Bowls Shoppe.

The Bowls Shoppe will not accept orders:

(a) If the Buyer does not offer to pay by one of the payment methods listed in this website; or
(b) If the Buyer's credit card provider does not confirm the payment.

The Bowls Shoppe will send the Buyer an e-mail acknowledging the Products ordered as soon as possible after the Buyer places an Order.  If The Bowls Shoppe does not accept the Buyer's Order for any reason, it will inform the Buyer by email in the same manner.

If the Buyer wishes to cancel an Order prior to shipment, the Buyer must contact The Bowls Shoppe Customer Service immediately on  03 9375 4820 and/or e-mail thebowlsshoppe@optusnet.com.au.  The Bowls Shoppe will endeavour to accommodate the Buyer's request, if the merchandise has not been shipped.

If the Buyer's entire order is cancelled prior to shipment, The Bowls Shoppe will apply a credit to the Buyer's credit card and may also apply a cancellation fee.

If an Order has already shipped, The Bowls Shoppe's normal returns and exchanges procedure will apply.

DELIVERY

Shipment of a standard order Product will occur between 1 to 6 business days after acceptance of an Order.  A Buyer cannot arrange collection of Orders from The Bowls Shoppe either in-person or via alternative courier.

The Buyer acknowledges that The Bowls Shoppe may, from time to time, be subject to production, delivery or other unforeseen delays and that The Bowls Shoppe may allocate distribution of Products ordered among its customers at its sole discretion.

If the Buyer's Order has not been delivered within a reasonable time, the Buyer should contact The Bowls Shoppe at: thebowlsshoppe@optusnet.com.au.

If no one is available at the delivery address to receive the Products, The Bowls Shoppe's delivery agent will leave an "unable to deliver" card at the address and the Buyer should follow the directions on that card to obtain delivery of the Products.   The Bowls Shoppe reserves the right to make partial delivery of an Order.

PAYMENT

Payment for Products purchased from The Bowls Shoppe via the Site can be made by Credit Card, Paypal, online via DirectOne, cheque, money order or direct bank deposit.

The Bowls Shoppe will verify the credit card information submitted by the Buyer and will advise the Buyer that the Order has been accepted.  The Buyer agrees to submit to The Bowls Shoppe such information as may be reasonably requested by The Bowls Shoppe for the authorisation and verification of its credit card purchases.

The Bowls Shoppe reserves the right to exercise its lawful remedies if a dispute arises over payment through the Buyer's credit card provider.  In particular, but without limitation, if the Buyer's credit card provider rejects a payment when due, The Bowls Shoppe at its discretion may delay or cancel delivery of Orders placed by the Buyer.

The Bowls Shoppe may also offset and deduct from any refund due to the Buyer all sums owed by the Buyer to The Bowls Shoppe.  If the Buyer's account is placed in collection, The Bowls Shoppe will be entitled to claim all reasonable expenses for collection, including legal fees incurred in connection therewith.

DEFECTIVE ITEMS AND WARRANTIES

All parts are covered only by manufacturer’s warranties and/or guarantees.

If an item arrives in not new condition as a result of a manufacturer defect, or a defect occurs during the intended use of the product, please contact us on 03 9375 4820 for further information.

The Bowls Shoppe Australia does not reimburse for labour, incidental, or any other costs related to the installation of products under any circumstance.

FREIGHT METHODS

The Bowls Shoppe will arrange delivery of all Products to the Customer using its nominated freight carriers.  A Buyer may not arrange its own courier to collect the Products from The Bowls Shoppe.

INCORRECT SUPPLY OF ORDER

If due to a warehouse or other error on the part of The Bowls Shoppe, the Buyer receives a Product which does not conform to its Order, the Buyer must contact The Bowls Shoppe within 7 days of receipt of the Product and may purchase a replacement Product from the Site after returning the original Product to The Bowls Shoppe, provided that the returned Product is in new condition with its original packaging unopened.

DAMAGED SHIPMENTS

All packages should be completely inspected at the time of delivery.  Damaged packages should be refused. Please then call the freight company or Australia Post (whoever is responsible for the package) and report the damage.  After contacting the carrier, please call The Bowls Shoppe on 03 9375 4820 for further assistance with the damaged shipment, and to make arrangements for a replacement.



RETENTION OF TITLE

The Products and any other goods delivered by the The Bowls Shoppe to the Buyer shall remain the sole and absolute property of The Bowls Shoppe as legal and equitable owner until such time as all money due to The Bowls Shoppe has been paid but shall be at the Buyer's risk from the time of delivery.

All information, services, products, and materials contained in this site, including text, graphics, and links, are provided on an "as is" basis with no warranty.  To the maximum extent permitted by law, The Bowls Shoppe disclaims all representations and warranties, express or implied, with respect to such information, services, products and materials, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, freedom from computer virus, and implied warranties arising from course of dealing or course of performance.  In addition, The Bowls Shoppe does not represent or warrant that the information accessible via this site is accurate, complete or current.  Price and availability information is subject to change without notice.
